Terms of Service
1. Acceptance
These Terms of Service ("Terms") are an agreement between you and CodeHS, Inc. ("CodeHS," "we," "us") governing your use of the Atlara websites and platform (the "Service"). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of a school or district, you represent that you have authority to bind that organization.
If your school or district has a signed service agreement or Data Privacy Agreement with us, that agreement controls over these Terms wherever they conflict.
2. The Service
Atlara is a college and career readiness platform: career and college exploration, readiness plans, course planning, goals, work-based learning, applications and financial aid tracking, counselor tools, family engagement, and related features. We may improve, add, or modify features over time; we won't materially reduce the core functionality a district has purchased during its subscription term.
3. Accounts & eligibility
- Student and staff accounts are created by or at the direction of a school or district (including automated rostering), or by invitation. Family accounts are created by invitation from a student or school.
- The Service is intended for students in grades 9–12 (age 13+). You must be 13 or older to create an account.
- You are responsible for keeping your credentials confidential and for activity on your account. Tell your school or us immediately about any unauthorized use.
- Account information you provide must be accurate.
4. School & district terms
- The school or district authorizes us to process student information as a school official under FERPA, as described in the Privacy Policy and any DPA.
- The school is responsible for obtaining any consents required for its students to use the Service, and for the accuracy of roster data it provides.
- School administrators control their organization's configuration, staff access, family links, and data lifecycle (export and deletion).
- Fees, subscription term, and service commitments are set in the applicable order form or agreement.
5. Acceptable use
You agree not to:
- Use the Service to bully, harass, threaten, or harm others, or to post content that is unlawful, hateful, or sexually explicit;
- Access or attempt to access another user's account or data you are not authorized to see;
- Probe, scan, disrupt, overload, or interfere with the Service or its security (see the Security page for how to report vulnerabilities responsibly);
- Scrape the Service or collect personal information of other users;
- Misrepresent your identity or affiliation, or use the Service to send spam;
- Reverse engineer the Service except where the law allows it despite this term; or
- Use the Service in violation of applicable law or school policy.
Schools may set additional rules for their students' use. We may suspend accounts that put other users or the Service at risk while we investigate.
6. Student work & your content
- Students own their work. Plans, goals, portfolio entries, resumes, essays, and other content you create in Atlara belong to you (and, where it is part of an education record, remain subject to your school's rights and responsibilities).
- You grant us the limited license needed to host, display, and process your content in order to operate the Service — for example, showing your plan to your counselor, or assembling your resume. This license ends when the content is deleted, except for backup copies that age out on schedule.
- You are responsible for the content you submit. Don't post anything you don't have the right to share.
7. Our intellectual property
The Service — including software, design, text, graphics, and the Atlara name and logo — is owned by CodeHS or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service as intended during your (or your school's) subscription. No other rights are granted.
8. Third-party content & links
The Service links to third-party resources — college websites, scholarship providers, government data sources, apprenticeship programs, and more. We don't control those sites and aren't responsible for their content, terms, or privacy practices. A listing in Atlara is not an endorsement, and scholarship or program terms are always governed by the third party offering them.
9. Planning information, not professional advice
Atlara provides planning tools and information — college costs and outcomes, career and salary data, scholarship listings, financial aid guidance, and state requirement summaries. This information is drawn from sources we believe are reliable, but it can be incomplete, delayed, or changed by the institutions that control it. It is provided for educational planning, not as financial, legal, or admissions advice. Always verify dates, requirements, costs, and awards with the college, scholarship provider, or agency directly, and consult your counselor for decisions that matter.
10. Privacy
Our Privacy Policy describes how we handle personal information and is part of these Terms. For schools with a DPA, the DPA governs student data.
11. Termination
- Schools may terminate per their agreement; on termination we provide data export and deletion as described in the Privacy Policy and the applicable DPA.
- Individual users may stop using the Service at any time; students' records are managed by their school.
- We may suspend or terminate access for material breach of these Terms, with notice to the school where the account is school-managed.
- Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, governing law) survive.
12. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular outcome — admission, scholarship, or employment — will result from its use. Some jurisdictions don't allow certain disclaimers, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data; and (b) our total liability arising out of the Service is limited to the amounts paid by the applicable school or district for the Service in the twelve months before the claim (or $100 where the Service is used at no charge). Nothing in these Terms limits liability that cannot be limited by law, and nothing limits a school's remedies under a signed DPA.
14. Indemnification
If you use the Service on behalf of an organization other than a public school district (which may be prohibited by law from indemnification), that organization agrees to defend and indemnify CodeHS against third-party claims arising from its violation of these Terms. Public school districts' obligations are as set out in their signed agreements and applicable law.
15. Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, except where a school's signed agreement specifies the school's home state (common for public districts) — in which case that choice controls for that school. Disputes will be resolved in the state or federal courts of the applicable jurisdiction, and each party consents to venue there. Nothing in this section prevents either party from seeking injunctive relief to protect data or intellectual property.
16. Changes to these terms
We may update these Terms as the Service evolves. If a change is material, we will update the date above and give notice — to district contacts for school-managed deployments — before it takes effect. Continued use after the effective date constitutes acceptance. Changes do not override a signed district agreement.
